CRICKETHERO INC. TERMS OF SERVICE
1. Introduction

Since January 1, 2004, all Canadian organizations engaged in commercial activities have been required to comply with the Personal Information Protection and Electronic Documents Act (“PIPEDA”) and the Canadian Standards Association Model Code for the Protection of Personal Information incorporated by reference into PIPEDA.

2. Application

This privacy policy applies to the collection, use, and disclosure of personal information provided to Cricket Hero Inc. and its related companies and business activities, including Cricket Hero (“Cricket Hero” or “We”) by customers of Cricket Hero (“You”).
This Policy is governed by the laws of Ontario, Canada, and the laws of Canada applicable therein.

3. Personal Information

Personal information is defined in PIPEDA as information about an identifiable individual, but does not include the name, title or business address or telephone number of an employee of an organization. In other words, it does not include the information that one expects to find on a business card.

4. Collection of Personal Information

We collect personal information from our customers in the regular course of doing business. This policy is designed to let customers, like you, know exactly how we're protecting the information you entrust to us.

By providing us with your personal information, you consent to the collection, use and disclosure of that information as described in this Policy.
We may collect some or all of the following information about you:

    • Address
    • Postal Code
    • Phone Number
    • Email Address
    • Date of Birth/Age*
    • Gender*
    • Payment Card number
    • Payment Card expiry date
    • Purchase history
    • Product/service preferences*
    • Customer satisfaction info*
    • Opinions about products and services*
    • Interests and hobbies*
  • N.B. An asterisk (“*”) denotes optional information disclosed by you.

You may also share your photo or image or links to your social media networking sites and usernames and email addresses for connecting your social media networking sites to our site.

When you visit our website, certain other types of information may be gathered indirectly:

  • (a) Internet Server Provider

    Cricket Hero’s website(s) are hosted on servers provided by an Internet Service Provider (“ISP”). Personal information, collected by the ISP, on Cricket Hero’s behalf, such as server log data, is managed in accordance with this Privacy Policy and is protected by applicable law.

    You should know that certain information about your traffic patterns are passively and automatically collected and linked to your Internet Protocol (“IP”) address. These unique IP addresses are assigned to all web users by the user’s ISP and are automatically logged by internet servers. Your IP address does not explicitly identify you but, in some circumstances, an IP address can be linked to you, only with the cooperation of your ISP. This may be linked in the course of an investigation of a security breach, for example, where the police are issued a warrant for such information by a court of competent jurisdiction.

  • (b) Server Logs

    You should also know that, in establishing internet connections, servers, including ours, automatically log information about visits to our websites. These logs record statistical information such as your IP address, type of computer operating system, the time and duration of your visit to our website and the specific pages requested/visited. It also discloses the type of domain, browser type, and geographic location. This information is provided in aggregate form to use and we use the data to improve our website experience. We do not link this information to any other data, including your personal information, except in the course of security purposes, as we discussed above in section (a).

  • (c) Cookies

    Cookies, which are small text files that contain a unique identification number, is deposited on your computer every time you visit our site. These cookies track information during your time at our website(s) and are stored temporarily in your computer’s memory. This information is used by us, and your browser, to facilitate and enhance your visits to our websites. They help you by remembering information, such as username (if you choose), for example, and also helps us by tracking the total number of unique visitors to a website on an ongoing basis and other information such as browser type and computer operating system. Cookie data is not cross-referenced with other types of personal information that you provide us.

    Cookies are common tools on the internet. Many browsers are set to automatically accept cookies. If you do not wish to accept cookies, refer to your internet browser software settings.

  • (d) Other

    If you access our website(s) or apps on a mobile platform, we may collect and record certain information such as your unique device (persistent / non-persistent), hardware type, media access control ("MAC") address, international mobile equipment identity ("IMEI"), the version of your operating system ("OS"), your device name, your email address (if you have connected to Facebook or Google+), and your location (based on your Internet Protocol ("IP") address). This assists us in understanding trends in usage and for troubleshooting issues with such mobile platform. We may also collect location information so that you see the correct version of the software and to interact with other users. If you do not want us to have access to this information, you should turn off the feature on your electronic device using the mobile platform although, as a result, the mobile platform may not work correctly.

We will retain information, including your personal information, for as long as it is needed for the purposes for which it was collected.

5. How do you use this information?

Some information is required to complete the website registration process and/or to complete a sale or other financial transaction. This is used by us to verify your identity and process online payment. We also use it to provide customer service to you and to administer contests which Cricket Hero may, from time-to-time offer to you.

Additional information, which is optional, is collected for the purposes of marketing and customer service or to send you email notifications and newsletters. You may opt out of these communications at any time.

We will obtain the necessary consents required under applicable privacy laws if we seek to collect, use or disclose your personal information for purposes other than those to which consent has been obtained unless otherwise required or permitted by law.

Your personal information may be processed, accessed and/or stored in Canada or another jurisdiction, and will be subject to the laws of that jurisdiction, if applicable.

If you connect to us using your social media networking site(s), such as Facebook, and use interactive features such as widgets, share features, or “like” buttons, such services may collect your IP address, the page you are visiting on our website/app, or may set a cookie in order to fuction properly. Such usage is governed by the privacy policy of the social media networking site providing the widget or service.

6. Withdrawal of Consent

You may withdraw your consent to Cricket Hero’s collection, use and disclosure of your personal information at any time, subject to legal and/or contractual restrictions and upon reasonable notice. Your withdrawal of consent to Cricket Hero’s collection, use and disclosure of your personal information may impact Cricket Hero’s ability to provide you with services.

You can ask Cricket Hero not to send you marketing communications by following the opt-out instructions in each communication or you may let me know by contacting Cricket Hero at [email protected]

Remember that if you connect to us using a social media networking site, such as Facebook, you may have to contact that service provider to remove the connection and and personal information.

7. Disclosure of Personal Information

Generally, Cricket Hero does not disclose your personal information to third parties without your consent unless permitted or required by applicable laws or court orders. It may be disclosed, for example, to recover unpaid accounts. Non-identifying data may also be shared with Cricket Hero’s partners, marketing firms, and third-party contractors.

If you enter a contest, organized by Cricket Hero, you may be required to consent to further disclosures to Cricket Hero’s partners and contest sponsors.

8. Accuracy of Your Information

It is important that the information that Cricket Hero has on file be accurate and up-to-date. We encourage you to keep your personal information on file with Cricket Hero up-to-date using the website’s self-service feature. We may, from time-to-time, ask you whether your personal information is up-to-date.

9. Safeguards

Cricket Hero makes use of various safeguards to ensure that your personal information is protected against loss, theft, misuse, unauthorized access, disclosure, copying or alteration. These include security software and firewalls to prevent unauthorized computer access or “hacking”; and internal passwords that restrict access to my electronic files.

We will store your information for as long as your account is active with us. You can cancel your account at any time and we will delete your information. If your account remains inactive for 18 months, your account will be terminated and all information will be deleted.

10. Access to your Personal Information & Compliance

You have a right to challenge the accuracy and completeness of your personal information and to have it amended, as appropriate. You also have a right to request access to your personal information and receive an accounting of how that information has been used and disclosed, subject to certain exceptions prescribed by law. For example, if the requested information would reveal personal information about another individual, your request for access may be limited or denied. If your request for access is denied, Cricket Hero will notify you in writing of the reason for the denial.

Cricket Hero will also respond to inquiries about its policies and practices relating to the handling of your personal information and will investigate all complaints and respond within 30 days of receipt of a written inquiry.

If the complaint is found to be justified, Cricket Hero will take appropriate measures to resolve it, including, if necessary, amending this Policy and Cricket Hero’s Procedures.

India was down and almost out yet again, but kept their spirits and hopes up to make another stirring comeback to wipe out the Blacks Caps 5-0. The Kiwis batting second needed just 66 off 60 with seven wickets in hand when the slide started. Navdeep Saini produced the turning point to get Tim Seifert caught at short midwicket. In the next over, Bumrah yorked Darryl Mitchell and the Indians were back in the match.

New Zealand has never lost all the matches in longer T20I series (three or more games) but is in danger of losing that record thanks to their inept finishing in this series. However, even if India win the fifth game, they’d still be placed only at the fifth spot in the international T20I team rankings. The Indians would like to continue with their experimentation for the big T20I world cup later this year in Australia.  Virat Kohli or KL Rahul may be rested and Rishabh Pant brought in. Rahul will assuredly keep the wickets in the ODI games, so he may be given a rest. Samson would need to display more patience and try to get his eye in before going for the big shots. Dube’s footwork is poor and he seems more keen on hoicking everything to the legside. But his bowling has been reasonably tidy and the selectors may give him a few more chances to check if he can cut it.  Rishabh Pant has become out of favor thanks to Rahul’s heroics with the bat and ‘keeping gloves. He’d like to keep himself in contention by proving his worth if he’s given a chance. On the bowling front, Shami may return to provide Bumrah much needed rest. Kuldeep Yadav may also get a look-in as he’s an important player in India’s white-ball plans.  For the Kiwis, Kane Williamson seems to have recuperated from his left shoulder injury and could return to lead the side. New Zealand’s management is confident that he is ready to play the game. Mount Maunganui is Williamson country and his scores of fans would love to see him score big on his home territory.  Colin Munro excelled with the bat in the fourth match and he has a great track record at Mount Maunganui, scoring at an average of 61.40 in five innings at a stunning strike rate of 193. The Kiwis have won laurels for their sportsmanship but a question mark has arisen over their ability to win close matches. They should take every opportunity to put the doubts to rest starting with this game.   The ground at Mount Maunganui has windy conditions that help swing bowling. However, the surface is a belter with good bounce and carry. The team winning the toss would prefer to bat first as the first batting side has won all the five matches here. Given India’s dominance, we predict that they’re going to sew up a brownwash here.

  The Kiwis needed just 7 runs off the last regulation over but they contrived to mess it up again. Shardul Thakur pulled off a Mohammed Shami and effected four outs including two run outs to take the game into the Super Over. The Kiwis have themselves to blame as they could not provide the finishing touches when needed despite being ahead all through the match. Bumrah bowled India’s Super Over and had two difficult catches missed. The Kiwis rattled off 13 in the six balls but they were comprehensively beaten by Rahul’s expertise and Kohli’s experience as the Indians met the target in five deliveries. Rahul smacked a six and four off the first two balls and then skied one to deep midwicket. Kohli smartly took a couple by placing the ball in the gap and then smote the fifth ball consummately to the boundary to pull off another exciting win.  When the Indians batted first after being put in, Samson was disappointing scoring just 8 off 5. The Indians lost wickets at regular intervals and were down 6-88 in the 12th over. Only Rahul was the redeeming point with 39 off 26 to maintain his consistent form. Manish Pandey stepped up when it counted and put together 43 valuable runs for the 7th wicket with Shardul Thakur who contributed 20 off 15. In fact, Pandey stayed till the end and finished with 50 off 36 to give India a fighting chance. Besides Samson, Dube and Washington Sundar also failed to capitalize on this great opportunity to impress. As a result, India looked 15-20 runs short. Santner and Sodhi choked the Indian innings returning collective figures of 4-52 in their eight overs. In the Kiwi chase, Guptill failed with the bat but Munro and Seifert lifted their games and put together 74 for the second wicket to keep their team on track. Munro blasted 64 off 47 and Seifert 57 off 39. For the Indians, Bumrah was amazing once again returning 1-20 in his four overs. Washington Sundar failed with the ball too going for 24 in two overs. Saini was better leaking just 29 runs in his four overs.  The Kiwis were well placed to win the match going into the final over but things went awry for them once again. Shardul Thakur bowled brilliantly to mess up the finish for the hosts. For his all-round effort of 20 off 15 with the bat and 2-33 off 4 overs with the ball, Thakur was declared player of the match.

  With the T20I series in the bag, India will look to provide opportunities to their bench with the view of preparing for the upcoming T20I world cup. At the same time, they’d like to maintain their winning streak and stranglehold over the Kiwis. Shami or Bumrah is likely to be rested in favor of Navdeep Saini. Kuldeep Yadav or Washington Sundar may be given a chance replacing Jadeja or Chahal. Sanju Samson would also be looking forward to playing a game.  However, Kohli and Shastri have a win-all mentality and would like to score a 5-0 victory over the Kiwis. Therefore, they may limit the experimentation and continue with more of the regulars to boost competitiveness. Sundar has been included in Kohli’s new ball plans for vast Australian grounds on which the T20I world cup will be held. Therefore, he may be given a preference in game 4.  Bumrah plays in India’s teams in all three formats and typically has a heavy workload. He may be given rest especially given the fact that he is returning from injury. Kohli and Rohit may play alternately in the last two games to give chances to the reserve batters. In addition, Pandey and Dube may also get better look-ins.  New Zealand has selected batsman Tom Bruce to replace Colin de Grandhomme who was a disappointment in the three matches. Given his great form, Williamson may well move to open with Martin Guptill pushing Colin Munro to number three. Mitchell Santner can be expected to play an important role in this match at Wellington’s Basin Reserve. This is because of his excellent record here with nine victims in five games at under six runs per over.  Santner was also sent up the order in the third game to boost the scoring rate and would like to contribute handsomely with bat too. Batting first is preferable at the Westpac Stadium as the side electing to bat first has emerged victorious in four of the last five games here. Teams batting first have scored an average of 178 here in those five matches.  A clear day has been forecast but the wind also plays a big role always at this open ground. The Kiwis have won six T20Is on the trot at this venue going back to 2014. In total, they have eight T20I victories here which is their highest number at any ground.  Both sides would not like to let up and will want to go hard at each other. We predict an Indian victory because of their excellent bench strength.
